General terms and conditions

These terms and conditions apply to all services provided by Harms Mental Well-Being with regard to the coaching services offered through the website www.mentalwell-being.nl.

Article 1 – Definitions



  • Contractor: Mental Well-Being, located in Klazienaveen, registered with the Chamber of Commerce under number: 97124079
  • Client: the natural person or legal entity that enters into an agreement with Mental Well-Being.
  • Agreement: the agreement between Client and Contractor regarding coaching.




Article 2 – Applicability



These terms and conditions apply to all agreements between Mental Well-Being and the Client.



Article 3 – Coaching and results



Mental Well-Being will support the client as best as possible throughout the coaching process. No guarantees are given for specific results. The client always remains responsible for the choices made and the results achieved.



Article 4 – Liability



Mental Well-Being is not liable for any direct or indirect damage resulting from the services provided, unless there is intent or gross negligence. In all cases, Mental Well-Being's liability is limited to the amount paid by the professional liability insurance, plus the deductible.



Article 5 – Cancellation and payment



  • Sessions can be cancelled free of charge up to 24 hours before the start.
  • In case of cancellation within 24 hours, 50% of the session fee will be charged.
  • In case of no-show without cancellation, the full rate will be charged.
  • Payment must be made no later than 48 hours before the start of the session.
  • If payment is not received on time, Mental Well-Being reserves the right to cancel or postpone the session.




Article 6 – Confidentiality and privacy



Mental Well-Being treats all personal data of the Client as strictly confidential, in accordance with applicable privacy legislation (GDPR). See also the privacy statement on the website.



Article 7 – Intellectual property



All materials provided by Mental Well-Being, such as workbooks, exercises, presentations, and other (digital) documentation, remain the property of Mental Well-Being. Reproduction, publication, or making these materials available to third parties without prior written permission is prohibited.



Article 8 – Complaints procedure



Complaints about the services must be submitted in writing within 14 days of their occurrence to leonharms@mentalwell-being.nl. Mental Well-Being will respond within 14 days of receipt and work with the Client to find a suitable solution.



Article 9 – Changes to the terms and conditions



Mental Well-Being reserves the right to amend these terms and conditions. Clients will be notified in writing or by email no later than 14 days before any amendment takes effect.



Article 10 – Applicable law and disputes



All agreements are exclusively governed by Dutch law.
